Jackson - Ticketed Events General Conditions

Effective 17 July 2024 and subject to change. For private events and vessel hire, please contact our Events Team for terms and conditions.

The following points apply to all Terms & Conditions:

  • Conditions of Carriage apply to all bookings
  • Travel insurance is strongly recommended
  • Groups over 35 guests are on request as additional special conditions and/or a private room or charter may apply
  • Refunds are not available for services not availed once travel has commenced
  • All refund claims must be made in writing
  • Refunds exclude cancellation fees, change of date fees and any third-party fees financial transaction fees including credit card surcharges
  • Additional terms and conditions may apply to promotional products that may be released from time to time, which will be indicated on the promotional material, website or notified by The Jackson accordingly
  • Special terms and conditions may apply to agent bookings. More information here.

Ticketed Cruises excluding Special Events

Payment

For bookings with less than 10 guests

  • Payment in full is required at the time of booking unless otherwise stated or agreed

For bookings with 10 or more guests

  • 30% deposit to confirm your booking
  • Balance due 7-days prior to cruising
  • Please advise guest numbers at the time of each payment

Date Changes

For bookings with less than 10 guests

  • One date change is permitted up to 24-hours prior to cruising without penalty and with any difference in the fare payable by the customer
  • Additional date changes incur a $20 per person non-refundable fee

For bookings with 10 or more guests

  • One date change is permitted up to 7-days prior to cruising without penalty and with any difference in the fare payable by the customer
  • Additional date changes incur a $20 per person non-refundable fee

Cancellation

For bookings with less than 10 guests

  • Cancellation within 72-hours prior to cruising will incur a 100% cancellation fee

For bookings with 10 or more guests

  • Cancellation within 7-days prior to cruising will incur a 100% cancellation fee

We recommend rescheduling your cruise to an alternative date, instead of cancelling, to avoid cancellation fees.

If the cruise is unable to operate due to unforeseen circumstances beyond our control, no cancellation fees apply. You may seek a refund, change the date of your booking, or a credit can be made with The Jackson Sydney towards another event within 12 months of original date of travel.

Group Allotments

  • Bookings are only considered confirmed when paid in full
  • The Jackson always reserves the right to release unsold seats if required
  • If we become full on your departure and/or cruise type, full payment will become due within 7-days of notification

Promotional Fares including Online Specials

Unless otherwise advised within the specific Promotion terms and conditions the following applies:

Prices & Payment: as per Ticketed Cruises except

  • Prices are variable and valid at the time of payment only
  • Credit Accounts are not available with Promotional Fares - full payment is required at the time of booking
  • Limited agent commission applies

Date Changes: as per Ticketed Cruises except

  • Subject to the sale and travel periods of the promotion
  • Any difference in the fare due to date change is payable at the time of change

Cancellation: as per Ticketed Cruises Cancellation Clause

Group Allotments: as per Ticketed Cruises Group Allotment Clause

Other Promotional Fare Terms and Conditions

  • Promotional Fares cannot be combined with any other offer
  • Promotional Fares do not apply to Special Events
  • Valid for sale for a limited time only, and are subject to change without notice
  • Limited availability - only a select number of tickets are available at promotional prices on any date
  • Black out periods may apply

Please remember that it is the customer’s responsibility to check the price carefully before payment is finalised.

Excluding New Year's Eve and any other selected Special Events that may be released and notified on occasion.

Agents: Credit Accounts are not available on Ticketed Special Events and limited commission applies.

Date Changes

Most special events fall on a single date, and therefore date changes are not available. For special events that run across multiple dates, one date change is permitted up to 24-hours prior to cruising for bookings with 1-9 guests and 14-days prior to travel for bookings with 10+ guests, with any difference in the fare payable by the customer. Please note, additional date changes incur a $20 per person fee, in addition to any difference in the fare

Cancellation

All payments are non-refundable, and cancellations incur a 100% cancellation fee

New Year's Eve Ticketed Special Event

Valid for New Year's Eve and any other selected Special Events that may be released and notified on occasion.

Payment: Full payment is required at the time of booking

Cancellation: All payments are final and non-refundable

Agents: Credit Accounts are not available on New Year's Eve Ticketed Special Event and limited commission applies.

All Ticketed Cruises, Special Event and New Year's Eve

The Jackson works closely with Destination NSW, Tourism Australia, City of Sydney and other precinct partners and event organisers, for major Sydney Harbour events including but not limited to New Year’s Eve, Vivid Sydney, the Sydney to Hobart Yacht Race and Australia Day. Cruises may operate to view spectacles, access special areas or participate in special event programs, organised by third parties that are outside our direct control. These may include fireworks, drone shows, nautical and lighting displays. By purchasing a cruise ticket, customers do so with the understanding that should these spectacles or special event programs be cancelled, the cruise will continue to operate as advertised and no refund will be applicable. Should we be notified in writing by the event organiser at least 48 hours in advance of the advertised departure time, that the spectacle or special event program will be significantly changed or cancelled, the company will endeavour to contact customers, or the customer’s booking agent, by the email provided, with considerations which may include a reduced price, alternate date, alternate cruise, cruise credit or refund at the company’s discretion. The Jackson accepts no responsibility for costs associated with travelling to or from the cruise. Travel insurance is strongly recommended.

Sale Agreement

  • The Jackson always reserves the right to disallow the resale of our products to third parties
  • Discounts to the Retail Rate cannot be advertised without prior agreement
  • Agent's Nett rates and services stated in this contract are for FIT travel program inclusions and bundling/packaging and not for direct sale via Booking Agent's customers who are end users (unless otherwise stated)

General Terms & Conditions of Carriage

In these conditions:

  • ‘Company’ means Captain Cook Cruises Pty Ltd and, where the context requires, its employees or agents.
  • 'Operator' means Captain Cook Cruises Pty Ltd trading as The Jackson
  • ‘Passenger’ means any person or persons on the cruise by virtue of this ticket.

The passenger acknowledges that during the cruise the vessel will be and remain under the absolute control of the Company and that the direction and control of the vessel and its crew is at all times the sole responsibility of the Master of the vessel. The Master of the vessel reserves the right to refuse entry of a passenger onto the vessel and to require a passenger to disembark the vessel in the Master’s sole discretion. The passenger acknowledges that the Master of the vessel has the sole and absolute discretion to vary the scheduled route or destination of the cruise if for any reason the Master of the vessel considers it necessary for the safety and welfare of the vessel, its passengers and crew.


The Company reserves the right to:

  • Substitute any other vessel other than the one designated for the cruise (including a vessel not owned by the company) provided that the substituted vessel is of a similar type and includes similar facilities to the vessel named in the cruise;
  • To cancel or abandon the cruise either before or during the cruise, if the Company or Master of the vessel considers in their sole and absolute discretion that the cancellation is necessary for reasons of weather or in the interest of the safety and well-being of the vessel, its passengers and crew and the Company will not be liable for any loss or expense incurred by the Passenger caused by such substitution or cancellation.

To the extent permitted by law, the Company, its related entities, employees and agents shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with the cruise. The Passenger releases the Company for any claim whatsoever and howsoever incurred including but not limited to a claim for death bodily injury damage or loss of property during embarkation and/or disembarkation to or from the vessel and/or at all times whilst onboard the vessel itself, unless caused by wilful misconduct or reckless disregard of the Company. In the event of breach of any of these terms by the Company, or a failure in whole or in part to provide any service that the company contracted to provide (either expressly or by implication), the remedy for any such breach of any term shall be limited only to the contractual value of the performance of service or obligation that was not performed by the Company, or alternatively part value of the service where there was partial performance of the service or obligation by the Company. Any liability shall be assessed by the Company’s own value of the service and/or obligation or part thereof that is the subject of any claim.

Passengers must not bring any alcoholic beverages or illegal substances onto the vessel.

Other Operators - Whilst all care is taken, no responsibility/liability whatsoever is borne or accepted by the Company for any other operator that is included, for any reason, as part of a package holiday, or conference or meeting within the Company’s Ship. The passenger agrees that any independent contractors with whom the Company so contracts provide their services subject to their usual terms and conditions.
